Bartlett was brought into this case less than two weeks before jury selection, replacing prior counsel who had expected the case to settle. The plaintiff was seeking more than $200,000 in damages arising from the theft of her Mercedes and other items of value from a parking garage in New York City.
Scott faced some significant challenges from the outset. With almost no time to prepare, he inherited a case with serious discovery problems, including missing surveillance footage, previously undisclosed witnesses, and records that had not been produced. During trial, the plaintiff pressed to have our answer stricken, witnesses precluded and for monetary sanctions against our firm, the predecessor firm and otherwise.
Scott was able to convince the court to deny those motions and the two-week jury trial commenced. Incredibly, following the close of testimony, Scott persuaded the judge to dismiss the entire case before it ever reached the jury!
This was an especially impressive result given the circumstances under which Scott inherited the case, the limited preparation time, and the obstacles he had to overcome.
